Terms of Service

Welcome to VisaOne. These Terms of Service ("Terms") govern your use of the services provided by VisaOne Pte. Ltd. ("VisaOne", "we", "us", or "our"), an employment agency licensed in Singapore. By engaging our services, you ("Client", "you", or "your") agree to be bound by these Terms.
1. Description of Services
VisaOne provides employment agency services, including but not limited to, consultation, document preparation, and application submission assistance for Singapore work and immigration passes on behalf of employers, candidates, and applicants. Pass types handled include, but are not limited to, the Employment Pass ("EP"), Dependant Pass ("DP"), S Pass, Letter of Consent ("LOC"), and other passes regulated by the Singapore Ministry of Manpower ("MOM") or other relevant government authorities.
Our services are advisory and administrative in nature. VisaOne does not guarantee the approval of any visa or pass application, as the final decision rests solely with MOM or other relevant government authorities.
2. Letter of Consent (LOC) — Applicant Self-Service Applications
The LOC service differs from VisaOne's other pass services in that the application form is completed and submitted directly by the applicant (the pass holder), not by an employer or third party. The following additional terms apply to LOC submissions made through VisaOne's public application portal.
- Eligibility. The applicant is solely responsible for confirming their eligibility under current MOM rules before submitting. VisaOne does not warrant that any individual is eligible for an LOC and is not liable for submissions made by ineligible applicants.
- Self-Certification. By submitting the LOC form, the applicant personally certifies that all information provided is true, accurate, and complete. VisaOne acts in an administrative capacity only and does not independently verify self-submitted data prior to MOM submission.
- Statutory Declarations. Declaration responses regarding refused entry, criminal conviction, prohibition from Singapore, and ACRA registration are treated as statutory declarations made by the applicant. Providing false or misleading answers may constitute an offence under Singapore law and may result in rejection, cancellation, or further legal consequences entirely independent of VisaOne.
- Document Authenticity. Uploaded Dependant Pass scanned copies are submitted by the applicant and will be shared with MOM. The applicant warrants that all uploaded documents are genuine and unaltered. VisaOne is not liable for consequences arising from fraudulent or incorrect documents uploaded by the applicant.
- No Government Fee. As of the last updated date of these Terms, MOM does not charge a government application fee for LOC applications. This may change at MOM's discretion and is outside VisaOne's control.
3. Client Obligations and Compliance
As a client engaging our services, you acknowledge and agree to the following core obligations:
- Accuracy of Information: You must provide true, accurate, current, and complete information as required for any application. You are responsible for the authenticity of all documents submitted.
- Compliance with Singapore Law: You agree to cooperate fully with VisaOne in adhering to all regulations, standards, and laws set forth by the MOM and other Singaporean government bodies. This includes, but is not limited to, the Employment Act, the Employment of Foreign Manpower Act, and the Tripartite Guidelines on Fair Employment Practices (TAFEP).
- Cooperation: You agree to provide all necessary documentation and information in a timely manner to facilitate the application process. Delays caused by your failure to do so may impact the application timeline and outcome.
- Candidate's Written Consent: In accordance with MOM regulations, you, as the prospective employer, are solely responsible for obtaining explicit written consent from the foreign candidate before instructing VisaOne to proceed with any work pass application or renewal. This consent must clearly show the candidate’s agreement to be employed by you (e.g., via a signed employment contract or offer letter). By engaging our services for a candidate, you represent and warrant that you have secured this consent and can produce it upon request by VisaOne or any government authority.
- Fair Employment Practices: You represent and warrant that all job descriptions, hiring criteria, and selection processes provided to or discussed with VisaOne are fully compliant with the Tripartite Guidelines on Fair Employment Practices (TAFEP). You agree not to request actions or make hiring decisions based on age, race, gender, religion, marital status, family responsibilities, or disability, unless a specific exemption is legally justifiable and documented.
- Accuracy of Job Advertisements: Should you engage VisaOne to assist with posting any job advertisements, you are solely responsible for the accuracy and completeness of the information provided for such postings. VisaOne is not liable for any claims or disputes arising from misleading or inaccurate content supplied by you.
4. Fees, Payment, and Refunds
Service fees will be outlined in a formal invoice or service agreement provided by VisaOne. Payment of the specified fees is required to initiate our services. Unless otherwise stated, all fees quoted are exclusive of Singapore Goods and Services Tax (GST), which will be charged at the prevailing rate if applicable.
Non-Refundable Policy: All fees paid to VisaOne are for professional services rendered and are non-refundable once services have commenced, regardless of the application outcome, withdrawal of the candidate, or cancellation of the application by the employer.
Government Fees: All government-levied fees (e.g., application fees, issuance fees) are separate from our professional fees and shall be borne fully by you.
5. Confidentiality and Data Protection
VisaOne is committed to protecting your privacy and handling personal data in compliance with Singapore's Personal Data Protection Act (PDPA). We will treat all information and documents you provide as confidential and will only use them for the purpose of fulfilling our services.
By providing VisaOne with a candidate's personal data, you represent and warrant that you have obtained the candidate's consent for the collection, use, and disclosure of their personal data to us and to the relevant government authorities for the purpose of the work pass application. 6. Termination of Services
VisaOne reserves the right to terminate or suspend services immediately, without refund, if:
- You fail to provide necessary information or documents within a reasonable timeframe;
- You provide false, misleading, or forged documents;
- You request VisaOne to perform any act that is illegal or unethical;
- You fail to make payments as agreed.
You may terminate our services at any time by providing written notice. However, no refunds will be issued for services already commenced or completed.
7. Limitation of Liability
VisaOne shall not be liable for any losses, damages, costs, or expenses arising from:
- The rejection of a visa or pass application by any government authority.
- Delays in processing times by government authorities.
- Inaccurate or incomplete information provided by you.
- Your failure to obtain the necessary written consent from a work pass candidate prior to application submission.
- Candidate withdrawal or refusal to accept employment after pass approval.
- Changes in government immigration laws or policies.
In any event, the total liability of VisaOne, if any, shall be limited to the total amount of service fees paid by you for the specific service in question.
8. Indemnification
You agree to indemnify, defend, and hold harmless VisaOne Pte. Ltd. and its directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, and fines (including legal fees) arising out of or in any way connected with your breach of these Terms, including but not limited to: (a) your provision of false, inaccurate, or incomplete information; (b) your failure to comply with any applicable Singaporean laws or regulations, including the Employment of Foreign Manpower Act and TAFEP guidelines; and (c) any claim by a candidate or third party that you did not have the proper authority or consent to initiate an application on their behalf.
9. Non-Solicitation
During the term of our engagement and for a period of twelve (12) months thereafter, you agree not to directly or indirectly solicit, recruit, or hire any employee of VisaOne with whom you have had contact during the provision of our services, without our prior written consent.
10. Force Majeure
VisaOne shall not be liable for any failure or delay in performing our obligations where such failure or delay is due to causes beyond our reasonable control, including but not limited to acts of God, war, strikes, government orders, changes in immigration regulations, pandemics, or failure of third-party communication networks.
11. Dispute Resolution
In the event of any dispute arising out of or in connection with these Terms, both parties agree to first attempt to resolve the dispute through good-faith negotiations. If the dispute cannot be resolved within thirty (30) days, both parties agree to submit the dispute to the Singapore Mediation Centre for resolution by mediation in accordance with its Mediation Procedure for the time being in force.
12. Governing Law
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Singapore.
13. Amendments to Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised version on our website. Your continued use of our services after such changes constitutes your acceptance of the new Terms.
